URGENT LEGISLATIVE REPORT

Early this morning the North Carolina House of Representatives successfully voted 69-45 to override Gov. Perdue’s veto of SB 727- No Dues Checkoff for School Employees, legislation which prohibits employees of local boards of education from requesting that dues and voluntary contributions (ie PAC contributions) for their employees’ association be deducted from their salary. With the Senate having already successfully overridden the veto over the summer, the successful House override means that SB 727 will become effective immediately. The House was initially expected to consider overriding Gov. Perdue's veto the Racial Justice Act repeal but SB 727 was brought up for consideration instead and a vote taken shortly after 1 AM. Representatives Jim Crawford (D-Granville) and William Brisson (D-Bladen) joined Republicans in voting for the override. With five members absent from the chamber the 69 votes were sufficient to meet the three-fifths majority threshold needed to override a gubernatorial veto.

NCAE has publicly indicated that they may challenge the vote in court; if this happens the court may issue a temporary restraining order (TRO). Barring issuance of a TRO school districts must implement the requirements of this legislation by next payroll. This legislation applies to any employee who has payroll deductions to any employee organizations and PACs- this would include NCAE, PENC, AFT, CTA and any other employee organization.

LEGISLATIVE UPDATE

The temporary restraining order (TRO) on the dues checkoff has been extended until March 11th. Both parties agreed to it and the judge signed the consent order this afternoon.

Our Mission

The mission of the North Carolina Caucus of Black School Board Members is to ensure that our communities are better informed about policies and practices implemented by governing bodies which affect minority students.

What We Do

The purpose of the Caucus shall be to:

1. Provide a forum for the unique problems faced by black school board members throughout the state;

2. Serve as an official advisory Caucus on matters relating to minority affairs of local school boards, school

communities, state and national school board associations;

3. Promote better relationships and understanding between minority school board members, their local boards, local

communities, and state and national school boards associations; and

4. Provide a means whereby minority school board members can actively participate in the dialogue on educational

problems, issues and concerns in conjunction with the North Carolina School Boards Association and other state

and national organizations committed to the continued growth and development of minority children.
